Transgender rights in California:

In California, the Civil Rights Department protects transgender persons against discrimination, harassment, and retaliation in the workplace. These protections apply during both the hiring and employment process.

Who is Transgender:

Under California Law, protections for transgender workers apply to people who are: gender non-conforming (meaning they identify with the same gender they were assigned at birth but do not portray themselves in a way that is stereotypical to that gender), transgender (someone who identifies as a different gender than the one they were assigned at birth), or a non-binary person (someone whose gender identity is not within the confines of male of female).

Protections for Transgender Workers:

Transgender persons have the right to be protected from employment discrimination. This can include, but is not limited to, being refused to be hired, facing worse working conditions than others, or not being promoted due to gender identity.

Transgender people are also protected from facing harassment at work. An employer cannot harass an employee or create a hostile work environment for their employee due to their gender identity. An example of harassment can be calling an employer by their incorrect name or pronouns intentionally. Most especially, any act or threat of violence is always unlawful and an employer can never threaten or harm an employee because of their identity. Also, an employer may not retaliate against someone for reporting harassment or hostility in the workplace. This means the employer is not allowed to take adverse action against an employee, like cutting down the hours of the complaining employee, simply because they reported an incident.  

Another very important right transgender people have in California is that an employer cannot exclude gender-affirming care from the employer-provided health plans. The health plans must cover medically necessary gender-affirming care.
